The Biden administration’s federal student loan relief scheme was being challenged by the taxpayers association and a conservative law firm.

Paying taxes “is often not enough to establish standing to challenge an action taken by the Federal Government,” the Supreme Court has held on numerous occasions.
The plaintiffs cited a 1968 Supreme Court decision that established a limited exception to this and claimed that this exception may be expanded.

Judge Griesbach pointed out that this restricted exception only applies to legislative spending and cited prior instances where Antonin Scalia and other justices of the Supreme Court argued that even this small exception ought to be ignored.
In the same way that the plaintiffs are concerned about the executive branch wiping off student loans, according to Griesbach, a subsequent government might undo the decision and demand that the money be paid back.

He added, “Those looking to take advantage of the programme may wish to take this potential into account before relying excessively on the benefits guaranteed.
As previously reported, those who qualify for Biden’s loan relief programme and make less than $125,000 annually or $250,000 for a household would have up to $10,000 in student loan debt forgiven. For Pell award applicants, who typically proven greater financial need, the sum is up to $20,000.

According to the federal Office of Financial Aid, around one in five Americans have student loan debt. According to the Education Data Initiative, the typical amount in 2020 was $30,000.
