As lawyers for the two sides squared up once more in Delaware court prior to the October trial that will decide the fate of the agreement, Elon Musk’s private chats with Twitter could land him back in his legal struggle with the company.
Musk’s usage of the secure texting programme Signal was one of the topics discussed during the more than three-hour hearing.
A screenshot of a conversation between Musk and Jared Birshall, the director of the Musk family office, is used by Twitter’s lawyers to support their claim that Musk was censoring communications made via the app.
Musk’s attorneys claim that the letter included mention of Mark Andersen, Morgan Stanley, and a “discussion concerning EU regulatory approval” for Musk’s Twitter transaction.
The interaction was captured on screen, according to Twitter’s legal team, after Musk and Birchall denied using Signal to discuss the purchase.
According to Engadget, the snapshot demonstrated that the message was set to be removed automatically.
The lawyers for Twitter also brought up a “lost text message” between Elon Musk and Larry Ellison, the head of Oracle and a co-investor in the Twitter deal. The morning before Musk tweeted that the Twitter transaction was “temporarily on hold,” Musk and Ellison had texted.
“The meaning of the texts is unclear, but Twitter’s attorneys point out that Musk wrote to Ellison, suggesting “good times,” before setting up a phone conversation with him.

The Tesla CEO’s team attempted to downplay the significance of his use of Signal, to which one of Musk’s attorneys retorted, “There is no indication that we destroyed the evidence.
She added, “Signal, you know, sounds like a sinister device.” In fact, according to testimony from Twitter executives, some of them are already using Signal messaging.
The existence of conversations sent over Signal between Jack Dorsey and Chairman Brett Taylor was referenced by Musk’s attorneys, who also pointed out that current CEO Parag Agrawal had also sent messages over Signal.
Notably, Twitter’s attorneys have utilised Musk’s private conversations collected through the legal discovery process in previous hearings in an effort to uphold the terms of the original agreement with Musk.
Twitter’s lawyers previously referred to a text message exchange between Musk and one of his Morgan Stanley bankers in which Musk cited worries about “World War III” as a justification for stalling his talks with Twitter.
In the coming two days, McCormick is anticipated to make a decision on Twitter’s suggestion to censure Musk. On October 17, a five-day trial that will decide the destiny of the agreement will begin.
